Complex products have been blamed for bringing about substantial investor losses, both for retail and institutional investors, and, even worse, for having caused and intensified the financial crisis. It should come as no surprise, then, that the European and national legislator have intervened heavily in this respect.
Ivan Peeters (Partner, PWC Legal) will discuss the practical implications of the Securitisation Regulation (EU) 2017/2402, which shall apply as from 1 January 2019.
Veerle De Schryver (Director, FSMA) will take a broader view and discuss other recent provisions shaping the regulatory framework of complex products, including the PRIIPs Regulation and the MiFID II target market obligations. Both have been applicable since January 2018 and continue to raise many difficult questions.
